Terms & Conditions
KateCate
Last updated: 30 September 2026
These terms apply to the KateCate website and purchases of digital music offered through it. Mandatory consumer rights continue to apply and take priority over any conflicting provision.
1. Contact KateCate
For orders, downloads, withdrawal requests or other questions, email katetencate@outlook.com or use our contact page. You can reach Kate on +31 6 267 53 133 or René on +31 6 244 99 358.
2. Music and previews
The shop offers downloadable music files. Each product page identifies the recording and its price. Audio previews are samples; they do not contain the full purchased recording. A music download is digital content, so no physical item is shipped.
You need an internet connection, sufficient storage and a compatible device or player to download and use the file. Check the product information and contact us before ordering if you are unsure about a format or its compatibility.
3. Prices, orders and delivery
Prices are displayed in euros. Review the order total, any applicable taxes or charges and the available payment methods before submitting an order. Additional charges require your express agreement.
Provide accurate contact and billing information so that your order can be administered. Download access is provided through the order process once the relevant payment and order conditions are satisfied. Check the order information for access instructions. If payment or download access is unavailable, contact KateCate for help; an unavailable payment method is not an instruction to transfer money elsewhere.
Keep your order confirmation and contact us promptly if something is incorrect or a paid download is missing. Corrections to future website prices or descriptions do not automatically change an existing purchase contract.
4. Personal use and music rights
A purchase gives you permission to download and listen to the recording for personal, non-commercial use. It does not transfer copyright or ownership of the recording, composition, lyrics or artwork. Rights belonging to composers, lyricists, performers and other rights holders remain with them.
Unless permitted by law or separately authorised by the relevant rights holder, you may not resell, redistribute, upload for public sharing, commercially exploit or use the recording in another production. Contact KateCate about additional uses or licensing.
5. Withdrawal from a digital purchase
Consumers normally have 14 days from concluding a distance contract to withdraw. Downloading or playing a file does not, by itself, remove this right. For digital content, the right can be lost only once supply begins with the legally required prior express consent, acknowledgement of that loss and confirmation. If those requirements have not been met, your statutory withdrawal rights remain.
To withdraw, send a clear statement to katetencate@outlook.com identifying your name, the order and its date. You may write: “I withdraw from my contract for [recording/order number], ordered on [date]. My name and contact details are [details].” Using this wording is optional. Where withdrawal applies, we reimburse the relevant payment without undue delay and within 14 days after receiving your withdrawal notice, using the same payment method unless you expressly agree otherwise, without a reimbursement fee.
6. Problems with digital content
The supplied music must match its description and meet applicable legal requirements. If a file is missing, faulty or cannot be used as reasonably expected, contact KateCate with your order details and a description of the problem. Depending on the circumstances, you may be entitled to a free remedy, a price reduction or termination and reimbursement under consumer law. These rights are separate from any right to withdraw.
7. Voluntary support
Contributions labelled “Donate” are voluntary support for KateCate’s music. They do not purchase a music download unless the offer expressly says so. No charitable status or tax deductibility is promised. Contact us if a contribution was made in error or if you need help with it. Applicable statutory rights are unaffected.
8. Accounts and appropriate use
Keep your account credentials confidential and notify us if you suspect unauthorised access. Do not misuse the website, interfere with its operation, attempt unauthorised access or submit unlawful material. We may take proportionate steps to protect the service and other users while respecting rights relating to existing purchases.
9. Privacy, responsibility and updates
Our Privacy Policy explains how personal information is handled. Nothing in these terms excludes responsibility that cannot legally be excluded or limits mandatory consumer remedies.
We may update these terms for future use and purchases. The version applicable when a purchase contract was made continues to govern that purchase unless a lawful change is agreed. Contact KateCate first if you have a complaint so that we can try to resolve it. Your right to use available consumer remedies or bring a claim before a competent court remains unaffected.
